1. Acceptance of Terms

By downloading, installing, or using the HerGlow application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and HerGlow ("we," "us," or "our") governing your use of the App and any related services.

2. Description of Service

HerGlow is a mobile application that provides AI-powered skincare analysis and personalised beauty recommendations. Our services include:

• Face scanning and analysis using artificial intelligence
• Personalised skincare routine recommendations
• Product recommendations based on your skin profile
• Weekly glow plans and beauty tips
• Progress tracking and skincare insights

The App is intended for informational and educational purposes only and should not be considered medical advice. Always consult a qualified dermatologist or healthcare professional for medical skin concerns.

3. User Accounts

To access certain features of the App, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.

4. Subscriptions and Payments

HerGlow offers both free and premium subscription features:

• Free Features: Limited face scans and basic analysis
• Premium Subscription: Unlimited scans, weekly glow plans, advanced recommendations, and premium features (weekly, monthly, or annual billing)
• Lifetime Access: One-time purchase granting access to premium features for the lifetime of the App. "Lifetime" means for as long as the HerGlow application remains available and operational. This does not guarantee perpetual access; if the App is discontinued or no longer supported, lifetime access will end at that time. No refunds will be provided in such circumstances.

Billing: Subscription fees are billed in advance on a recurring basis (weekly, monthly, or annually). Payment will be charged to your Apple App Store or Google Play Store account at confirmation of purchase.

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation: You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation will take effect at the end of the current billing period.

5. Refund Policy

All purchases are processed through the Apple App Store or Google Play Store. Refund requests must be made directly to Apple or Google in accordance with their respective refund policies:

• Apple App Store: Request a refund
• Google Play Store: Request a refund

6. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any laws
• Upload images of anyone other than yourself without their consent
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App or servers
• Use automated systems or software to extract data from the App
• Share your account credentials with others
• Circumvent any access restrictions or security measures

7. Intellectual Property

The App and its original content, features, and functionality are owned by HerGlow and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any images you upload to the App. By uploading images, you grant us a limited licence to process and analyse them solely for the purpose of providing our services.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or completely secure. The analysis and recommendations provided are generated by AI and should not replace professional medical advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERGLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms in the App or on our website. Your continued use of the App after such modifications constitutes your acceptance of the revised Terms.

11. Apple App Store Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and HerGlow only, not with Apple Inc. ("Apple"). HerGlow, not Apple, is solely responsible for the App and its content.
• Your use of the App must comply with the App Store Terms of Service.
• The licence granted to you is limited to a non-transferable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the App Store Terms of Service.
• HerGlow is solely responsible for providing any maintenance and support services for the App. Apple has no obligation to provide any maintenance and support services.
• HerGlow is solely responsible for any product warranties, whether express or implied by law. Apple has no warranty obligation.
• HerGlow, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
• In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, HerGlow, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
• You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must also comply with Apple's Licensed Application End User License Agreement, available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
